UPDATED LABOR AND EMPLOYMENT GUIDANCE FROM U.S. DEPARTMENT OF LABOR

Late yesterday, the United States Department of Labor issued a temporary rule concerning both the Families First Coronavirus Response Act (“FFCRA”) and the Coronavirus Aid, Relief, and Economic Security Act (“CARES Act”).  It can be found here:  https://www.dol.gov/sites/dolgov/files/WHD/Pandemic/FFCRA.pdf

While government rules and regulations are not the legal equivalent of statutory law, an employer’s reliance upon them is universally viewed by the courts and government tribunals as providing a good faith defense to alleged non-compliance with statutory requirements.  Accordingly, human resources professionals should find these regulations helpful in making employment decisions in the wake of the recent passage of both the FFCRA and the CARES Act.
